Married 22 May 1833 at Fremantle - second marriage for both. John married Mary Ann Hokin a widow whose husband had been drowned eighteen months earlier in a boating accident on the Swan River. This union was of very short duration as John was convicted with several others of having plundered the wreck 'Cumberland' and was transported to Van Diemens Land per the government schooner Ellen on 25 March 1835. He died in the Launceston hospital and was buried on 28 October 1839 having served four and a half years of his seven year sentence. Mary Ann died in 1876 aged 88 years.
