Hugh was three times tried and convicted and was imprisoned by court martial immediately prior to his departure for the Colony. Discharged in 1851. Returned to Western Australia with the Enrolled Pensioner Guards. Hugh died 10 February 1893 at the Mt Eliza Depot, Perth.
